Terms & Conditions

  1. Evaluation Results

    If the details / documents submitted by the Applicant do not conform / meet the criteria of Conformity certification, then an email is sent to the Applicant to review and re-submit the correct details / documents.

    If the details and documents submitted / re-submitted by the Applicant conforms / meets the criteria for Conformity certification, then a recommendation letter is generated by NITA-U IT Certification Office for grant of Conformity Certification to the applicant by NITA-U.

  2. Validity Period

    The validity of the Level 1 & Level 2 Certification, issued by the NITA-U, shall be for 18 months from the date of issue, subject to validation through two Inspections - one after 6 months and another after one year.

    The validity of the Level 3 certification shall be for 36 months from the date of issue, subject to validation through an Inspection after every one year (two Inspections in total).

  3. Suspension

    A certificate may be suspended for a limited period, in the following cases:

    • Improper use of the certificate or the mark, e.g. misleading prints or advertisement, which is not suitably resolved through retractions or appropriate remedial measures
    • If there has been any other contravention to the IT Conformity Certification Agreement, executed with NITA-U
    • If any of the supporting documents have not been renewed upon its expiry with in the validity period of the Certificate
    • The suspension will be cancelled once the cause of suspension is removed

  4. Revocation

    A Conformity certificate may be revoked in the following cases:

    • Adequate measures are not taken by the certified provider to resolve the suspension, within the specified time-period mentioned
    • If there has been a major contravention, or multiple contraventions, to the IT Conformity Certification Agreement of such a nature that immediate revocation is deemed necessary by NITA-U
    • If the Conformity certificate-holder is banned from operation by relevant regulatory authority
  5. Re-instatement
    • NITA-U may reinstate a suspended certificate where it is satisfied that the IT Training Institution has addressed the matters that were the reasons for the suspension, and after payment of the requisite fees.

    • An IT Training Institution, whose certification has been revoked, may make a new application but only after one year of revocation.

  6. Renewal of Certificates
    • Only Level 3 Certificate holder shall be eligible for renewal of certificate upon expiry of an existing certification.

    • The Certificate holder shall apply for renewal of his Certificate six months prior to the expiry of the Certificate so that the renewal is processed in time and the Certificate validity continues without a break.

    • A Level 3 Certification shall only be renewed where NITA-U is satisfied that the holder of the certificate continues to meet the requirements for certification and the prescribed fees have been paid.

  7. Notification of Changes/Deviations

    The certified Provider is responsible for notifying NITA-U IT Certification Office changes to the following:

    • Entity / Individual Name
    • Address / Site (premises)
    • Entity Ownership
    • Entity Logo
    • Nominated Management Representative / Alternate
  8. Extension/Reduction of Scope of Certification
    If an applicant wishes to extend or reduce the scope of certification, they should contact NITA-U authorized Certification Officer and complete the relevant extension/reduction to scope giving the following details:
    • Addition or reduction in services required
    • Change of site location
    • Addition of site locations
  9. Black-listing of Certificate holders
    The Applicant will be excluded from the certification, If
    • The Certificate holder is found to be indulging in criminal activities and convicted by the Court of law.
    • The Certificate holder carries out any unlawful activity in violation of the law of land and has been punished or blacklisted by any Government agency.
  10. Verification of Certificates
    The Certificates issued by NITA-U should be verifiable from a Certification Portal.
  11. Replacement of Certificates lost by holders
    The certificate holder may apply for a duplicate Certificate in case he loses the original certificate and requires a replacement certificate. This shall be issued within a period of 5 working days from the date of receipt of an authenticated request, as per laid down procedure, from the Certificate holder.
  12. Display of Certificate Holders' List
    A list of the names and other details of all entities that have been provided with Conformity Certificates shall be published on the NITA-U IT Certification Office website within relevant sections.
  13. Force Majeure
    Neither the Applicant nor NITA-U will be in breach for failure to carry out undertakings due to factors outside the control of either party, including, but not limited to, Acts of God, labour disputes, strikes, lock-outs, shortages of material or labour, fire, flood, criminal acts or unexpected failure of properly maintained and serviced machinery or equipment.
  14. No Assignment
    The Conformity Certificate is personal to the Certification Object to whom it has been awarded and the entity is not authorised to assign or transfer or deal in any other manner with any or all of its rights. Each Certification Object confirms that it is acting on its own behalf and not for the benefit of any other entity.
  15. Limitation of Liabilities
    Except for liability for death or personal injury directly resulting from the NITA-U's IT Certification Office acts or omissions, NITA-U's IT Certification Office liability in respect of any single event or series of events for breach of its obligations in these Terms and Conditions shall be strictly limited to the amount of certification fee payable by the Certification Object to NITA-U IT Certification Office.
